Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Pubwex, a social media content management and AI-generation platform (the “Service”). By creating an account or using any part of the Service, you agree to be bound by these Terms.

If you are using Pubwex on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract to use Pubwex. The Service is intended for business and professional use. By using the Service you confirm that you meet these requirements.

2. Accounts & Access

• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately at info@pubwex.com if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• You may not share your account with others or create accounts on behalf of third parties without permission.

3. Acceptable Use

When using Pubwex, you agree not to:

• Generate or publish content that is unlawful, defamatory, harassing, or fraudulent
• Violate the terms of service of any social media platform you connect
• Use the AI generation features to produce spam, misinformation, or deceptive advertising
• Attempt to reverse-engineer, scrape, or disrupt the Service or its infrastructure
• Use the Service to infringe on intellectual property rights of any third party
• Circumvent any access controls or rate limits imposed by the Service

You are solely responsible for all content generated and published through your account. Pubwex is a tool; the legal and ethical responsibility for what you publish rests with you.

4. AI-Generated Content

Pubwex uses Anthropic's Claude API to generate social media posts based on inputs you provide. By using the AI generation features you acknowledge that:

• AI-generated content may be inaccurate, incomplete, or inappropriate for your specific context.
• You must review all AI-generated content before publishing.
• We do not guarantee that generated content is original or free from third-party intellectual property claims.
• Your use of AI-generated content is also subject to Anthropic's Acceptable Use Policy.

5. Intellectual Property

Your Content

You retain ownership of all content you create or upload to Pubwex, including company profiles, notes, and any posts you save. By using the Service, you grant us a limited, non-exclusive licence to process and store that content solely to provide the Service to you.

Our Platform

Pubwex, its branding, design, software, and underlying technology are owned by us and protected by intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the platform without our express written permission.

6. Third-Party Platform Integrations

Pubwex integrates with third-party social media platforms (LinkedIn, Instagram, Facebook, X / Twitter). Your use of those integrations is subject to the respective platform's own terms of service. We are not responsible for changes to third-party APIs, account suspensions imposed by those platforms, or any loss of access resulting from platform policy changes.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Pubwex and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service — including but not limited to loss of revenue, data, or goodwill — even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access at our discretion if we believe you have violated these Terms, without prior notice for serious violations. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (such as IP ownership, disclaimers, and limitation of liability) will do so.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Turkey.

11. Changes to These Terms

We may revise these Terms from time to time. The “Last updated” date at the top of this page will reflect any changes. Continued use of the Service after revised Terms are posted constitutes your acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify users in advance.
